24, 1993 THE TENNESSEAN state settle bid lawsuit Associated Press Pet Inc. is the fifth dairy products company to settle a bid-rigging lawsuit with the state, Attorney General Charles Burson said yesterday. Burson said the $300,000 settlement will be distributed to school districts in Tennessee. Pet distributed milk and dairy products to school systems until 1985. In a complaint filed in U.S.

District Court, the state alleged Pet employees and officers violated federal and state antitrust laws by discussing proposed bid prices with other school milk suppliers in upper East Tennessee. "They agreed upon which milk supplier would win particular school systems before submitting their bids for consideration," Burson said in a statement. Other settlements have been reached by the state with Flav-0-Rich Land0-Sun Dairies Southern Bell Dairy Co. and Broadacre Dairy, a division of Weigel's Inc. Neelye Grace Ashton Doggett, 80, Pickens Road, Lynnville, a homemaker, died Tuesday, Lewisburg (Tenn.) Community Driver guilty 4th DUI, By KIRK LOGGINS Staff Writer A North Nashville man's second trial on vehicular homicide charges resulted in a conviction yesterday as the jury found him guilty of recklessly trying to beat a train crossing Charlotte Avenue in 1991. The Probate Court jury also convicted William Eugene McGinnis, 33, on a fourth drunken driving offense and a charge of driving on a revoked license. The jury fined him $11,500 on the three charges. Judge Jim Everett revoked McGinnis' bond and ordered him taken into custody, pending a sentencing hearing July 29. McGinnis is facing a sentence between three and years.

McGinnis' first trial, in April 1992, ended with a jury deadlocked 10-2 in favor of conviction. The of vehicular driving on Davidson foreman of that jury said two members of the panel were not convinced that McGinnis was driving the car in which he and a friend, Rydell Coleman, were riding on April 8, 1991. Both men were thrown from the 1988 BMW M3 when it was struck by a CSX Railroad locomotive at 41st and Charlotte avenues. Coleman, 24, was killed instantly, while McGinnis suffered several broken bones and a deep cut to his neck. Prosecutors presented proof that the car was registered to McGinnis' mother, Dr.

Eugenia McGinnis. Coleman's girlfriend testified that William McGinnis was driving when he and Coleman left her home a few minutes before the homicide, revoked license crash. William McGinnis, of 3407 Geneva Circle, did not testify. He registered .10 on a blood-alcohol test after the wreck, which is the minimum amount required for a legal finding of intoxication. Police said McGinnis also had marijuana, cocaine and a barbiturate in his bloodstream, but prosecutors did not present testimony about those drugs during the second trial.

Coleman had cocaine in his blood, as well as 7 grams of cocaine in his sock, when he was killed, police said. Coleman's sister, who is administrator of his estate, has filed a civil damage suit seeking $1.75 million against William McGinnis, his mother, who is a dentist, and his father, Dr. Charles W. McGinnis, who i is an internist and an instructor at Meharry Medical College.
